and the mobile application. Aptamed Care Solutions Private Limited owns and provides the services through the website www.aptamedcs.com and web application. Please go through terms and conditions before you access the website or app or register for our services. Your visit to the website www.aptamedcs.com and registration for our services on the website constitute a legal agreement between you and Aptamed care solutions as defined below. For the terms and conditions purpose the term “Service providers” using the website or app refer to clinic, medical practitioner, clinic personnel, diagnostic center personnel, pharmacy personnel and any user registered on Aptamed website. The terms “user” “you” or “your” refers to registered user, service providers, other users visiting the website or app or registered on website or app. Term app refers to mobile application. “Aptamed” refers to Aptamed care solutions private limited.

TERMS AND CONDITIONS:

The Agreement applies to –

Clinic or Hospital or Medical Practitioner similar practice setting including designated users of such practices who is registered or intend to register on Aptamed website or app to use our services. 

Patient and his/her representatives who is registered or intend to register on the Aptamed website or app to use our services.

Diagnostic center registered or intend to register on Aptamed website or app to use our services.

Pharmacy registered or intend to register on Aptamed website or our app to use our services

Other Users of the website - individuals who are registered or intend to register on website or app and is not in the categories mentioned above.

The Agreement applies to the services made available by Aptamed on the Website or app which are as follows:

Clinics, Hospitals and Medical Practitioners: Listing of practices or practitioners, their profiles and contact details for patients, diagnostic centers, pharmacies, other Users, and individuals using the website or app or visiting the website or the app.

Diagnostic Centers: Listing of diagnostic center, their profiles and contact details for patients, other Users and individuals using the website or the app or visiting the website or the app

Pharmacies: Listing of practices pharmacies, their profiles and contact details for patients, other Users and individuals using the website or the app or visiting the Website or the app.

Patients: Service to register on the website or app, create and maintain individual patient account with personal information, Health records, reports, prescriptions, and miscellaneous information. Search for Practitioners by name, specialty, and location. To schedule online appointment for clinic or telemedicine visits with the medical practitioner. To schedule appointment for diagnostic tests at a diagnostic center.

You irrevocably accept all the terms and conditions in this Agreement per the  Terms of Service and Privacy Policy by visiting the website or app or using our services and agree to abide by them. This Agreement supersedes all previous oral and written terms and conditions communicated to you relating to your use of the website or app. If you do not agree with the terms and conditions of the agreement, please do not use the website or any Services.

You can use the website or the app per the terms and conditions of this agreement only. Agreement also describes how your account information and data will be maintained and used on registering with Aptamed. 

Your access to use of the Website or app services will be solely at the discretion of Aptamed. Aptamed reserves the right to modify or terminate all or any part of the Agreement for any reason and at any time in its sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the website or App thereafter. Such modifications shall be informed to you through electronic mail. Your use of the Website following any such modification constitutes your agreement to follow and be bound by the Agreement so modified. It is your responsibility to read the Agreement at regular intervals to be up to date with the modifications even if not communicated through email.

You must be 18 years of age or older to register, visit the website or app, use the services, or use the website or app in any manner. By registering, visiting, or using the website or the app you approve that you are 18 years of age or older, and that you have the right, authority and capacity to use the website or app services. You agree to abide by this Agreement.

We reserve the right to withdraw or amend this website or App, and any service or material we provide on the Website or App, in our sole discretion without notice and without liability. From time to time, we may restrict access to some parts of the Website or App, or the entire Website or App, to users, including registered users.

You agree that all information you provide to register with this Website or App or otherwise, including but not limited to through the Website or App is current and complete. You consent to all actions we take with respect to your information consistent with our Privacy Policy.

You acknowledge that your account is personal to you and agree not to provide any other person with access to this website or App using your username, password, or other login information. It is your responsibility and agree to ensure that you exit from your account at the end of each session. It is recommended not access your account from a public or shared computer and if you do access it is your responsibility to be cautious when accessing your account from a public or shared computer so that others do not have access to your security or personal information.

PERSONAL DATA

Aptamed through website or app on registration has access to registered users’ personal email, phone number, Aadhaar number, date of birth and communication address to provide you access to book appointments, co-ordinate patient care between various points of care such as diagnostic center, clinic and pharmacy. This information may be used to support patient’s use of our services in case of technical difficulties.

Aptamed through its services collects information relating to accessing the website or app and anonymous data of your usage. The collected information will be used only for improving the quality of our services and to develop new services. It is user’s responsibility to read and understand the terms and conditions as well as Privacy Policy, so that he or she has the knowledge of the fact that certain information is being collected and the purpose for which the information is being collected. The user also understands the means of collection, maintenance of the information and intended recipients of the information. The user has their rights available with respect to such information.

If a user or the service provider provides any information that is untrue, inaccurate, not current or incomplete or if Aptamed has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Aptamed has the right to discontinue the services to the user or the service provider at its sole discretion.

If Aptamed determines that user or the service provider have provided fraudulent, and inaccurate information Aptamed reserves the right to immediately suspend user or service provider access to the website or app or any accounts with Aptamed and take appropriate legal action. User or the service provider shall be liable to and need to compensate Aptamed for any losses incurred because of fraudulent information.

Aptamed shall not be responsible for the authenticity of the personal data or information supplied by the user to Aptamed staff or practitioner or clinic or diagnostic center or pharmacy personnel or any individual on behalf of Aptamed.

It is responsibility of the user to maintain the confidentiality of the user’s account information on registering for our services on the website. The user account information includes access, password, OTP and other information used for registration. It is the responsibility of the user to notify Aptamed of any suspected unauthorized use of the user’s account access.

In case of unauthorized use of the user account Aptamed will not be liable for users’ losses. User may be liable for the losses of Aptamed or patient care providers who provide care through Aptamed website or app.

Aptamed has the right to disable any user name, password or other information, whether chosen by the user or provided by Aptamed, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these terms of use.

PRACTITIONER INFORMATION AND SERVICES

Medical Practitioner information is displayed on the website and app. Profile and practice information of the Practitioners such as specialty, qualification, location, visiting hours, and other details will be listed on the website. Aptamed takes reasonable efforts to ensure that such information is accurate and updated frequently. Aptamed cannot be held liable for any inaccuracies or inconsistencies in the practice information since that information is obtained with reasonable efforts.

The practitioners listing is an automated system that lists the Practitioners and their practice information on Aptamed website or app. As mentioned above automated computation of the various practitioners determine the listing order. Aptamed will not be held responsible for the accuracy and the relevancy of the listing order of the Practitioners on the website or app.

Services provided by Aptamed or any of its service providers are provided on an as available basis, and without any warranties. Aptamed does not guarantee the accuracy of any content or information provided by service providers on the website or app. 

User and the service providers can utilize following services provided by Aptamed.

Scheduling Appointment: User can schedule an appointment with the service providers through Aptamed website or app. User will receive a confirmation of the appointment through SMS. However, Aptamed has no liability if such an appointment is later cancelled by the Medical Practitioner, or the same Practitioner is not available for appointment. If a user schedules an appointment or utilizes services from a service provider through Aptamed website or app, the user shall be doing so at their own risk.

You may be required to make payments to services providers or Aptamed to use certain services through the website or App. The terms and conditions relating to such payments are governed by the Terms of Use, the Privacy Policy, cancellation, and refund Policy as explained below.

Aptamed or service providers make their best efforts to ensure that an appointment taken or order made by a user on its website or App with any service provider or seller is satisfied by such service provided by the service provider, however, does not make any guarantees or warranties that such appointments or orders will be confirmed and delivered. You understand that these services are offered and sold by service providers that Aptamed has no control, directly or indirectly, over such service providers. 

Telemedicine visits: Medical practitioner assigned on the online appointment schedule to a user shall respond promptly to a communication received through the Telemedicine visit using the website or the App. The medical practitioner shall provide the best diagnostic or/and treatment advice possible using the information available through the telemedicine visit. Per the telemedicine visit if more information is required or a physical examination must be conducted before making any recommendations, then the medical practitioner must state those requirements to the user promptly. Medical practitioner shall comply with all applicable terms and conditions, laws, including Aptamed’s Privacy Policy and other Terms of Use and acknowledge that Aptamed may assign a user to any medical practitioner, with or without reason, considering the user’s best interests always.

Medical Records

Medical Practitioner: Aptamed website or App can be used by medical practitioner to manage and store all medical records of a patient in patient’s chart with easy access. This information includes Patient profile, Diagnosis, diagnostic reports, prescriptions, Immunizations / Allergies, Consult Reports / Patient Visit summary etc.

User/ Patient: Aptamed user web application or app can be used by user to manage and store all medical records in their personal chart with easy access. This information includes Patient profile, Diagnosis, diagnostic reports, prescriptions, Immunizations / Allergies. 

Diagnostic Reports

Medical Practitioner: Medical practitioner can manage flow of diagnostic test orders between practitioner’s clinic and diagnostic center electronically in closed loop. The flow of orders is from clinic to diagnostic center, but communication is bidirectional, augmented by automated and manual messaging system. Once the diagnostic reports become available the diagnostic center will upload the reports to patient chart which then can be accessed by both practitioner and the patient. Please note this is possible only if both the physician and the diagnostic center use Aptamed website or App.

User/Patient: Patient can store all the diagnostic reports in their chart with easy access. 

Prescriptions

Medical Practitioner:  Practitioner can manage prescriptions with features as available and mange flow of prescription orders between clinic and the pharmacy electronically through closed loop of orders through e-prescription. There will be provision for bidirectional communication augmented by automated and manual messaging system. Please note this is possible only if both the physician and the pharmacy use Aptamed website or App.

User/ Patient:  Patient can store all the prescriptions in their chart with easy access. 

Patient-Doctor Relationship and Emergency Use

Please note that some of the content, text, data, graphics, images, information, guidance, and other material that may be available on the website may be provided by individuals in the medical profession. The provision of such Information does not create a licensed medical patient-doctor relationship, between Aptamed and user and does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition. The information provided is to assist you with locating appropriate medical care from a qualified medical practitioner.

It is hereby clarified that, the Information that you obtain or receive from Aptamed, and its employees, service providers or otherwise on the website or app is for informational purposes only. In no event shall we be liable to user or anyone else for any decision made or action taken by the user in reliance on such information. Aptamed website or app or services provided are not intended to be a substitute for getting in touch with emergency health services. If you are an user facing a medical emergency either on your or another user’s behalf need to contact an ambulance service or hospital directly.

LIABILITY AND DISCLAIMER

Aptamed assumes no responsibility and shall not be liable for any damages to user’s equipment on account of user’s access to Aptamed website or app to browse or download any content from Aptamed website or app. User accesses the website at their own risk.

Aptamed disclaims all liability arising out of the user’s use of the Aptamed website or app, the Services provided by other users and the information provided by the users on the website or app. Aptamed disclaims any opinion or suggestion given by Aptamed or any service providers in relation to any user or services provided by such User.

Third party website links may be available on Aptamed website. Aptamed does not endorse the linked site and user may use the website links and these services are accessed at user’s own risk.

Aptamed care solutions website, the App and their entire contents and features are owned by the Aptamed, its licensors or other providers of such material and are protected by Indian and international copyright, trademark, patent, and other intellectual property or proprietary rights laws. This refers to functionality which includes but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof.

You agree to use the Website and App for your personal, non-commercial use only. You agree not to reproduce, republish, distribute, modify, publicly display, download, store or transmit any of the material on our Website or App, except when your computer or the mobile device or any other device you use to access the website or app account may temporarily store copies of such materials as required to use the services. You may store files such as health records, lab tests and prescriptions in your account and you agree to do that under secure conditions without any risk to the website or app. In case Aptamed suffers any damages due to improper use of the document upload service resulting from malware or virus etc during your process of  uploading the documents you accept all liability and agree to incur all the expenses due to the damages.

You may print or download certain documents form your account on the website or App, these documents include, reports, prescriptions, and profile cards. The provision to print from the website is for your own personal and non-commercial use only. The print provision should not be used to reproduce, publish, or distribute for non-personal or commercial purpose. You agree not to modify any material printed from your account on the website or app. You agree not to use any illustrations, photographs, video or audio sequences or any graphics separately from the accompanying material. You agree not to delete or alter any copyright, trademark or other proprietary rights notices from copies of materials from the website or App.

If you access any part of the website or App in breach of the terms of Use, your right to use the website or App will cease immediately.  No right or title to the website or App or any content on the website or App is transferred to you, and all rights not expressly granted are reserved by  Aptamed. On breech of the agreement you must return or destroy any copies of the content you have made from the website or app. Any use of the website or App not expressly permitted by these Terms of use is a breach of these terms of use and may violate copyright, trademark and other laws.

You must not use without the prior written permission of the Aptamed any of the names, logos, service names, product names, web designs and captions on Aptamed website or App. 

Aptamed name, logo, related names, service names, product names, web designs and captions are trademarks of the Aptamed or its affiliates. By accessing or registering the website or app you agree to use the website or App only for lawful purposes and in accordance with these Terms of use. 

You agree not to use the Aptamed website or app in a manner that could damage, disable, overburden, or harm the website or the app. On accessing the website or app, registering on the website or app you agree not introduce any viruses, bugs or other material which is malicious or technologically harmful. You agree not to use spyware, malware, Artificial intelligence device to access the website or App for purposes such as monitoring or copying any of the content on the website or App. You agree not to engage in activities that impede the functioning of services provided by the service providers, website, or App. You agree not to copy any of the material on the website or App for unauthorized purpose. You agree that without our prior written consent will not use any device, software or means that interferes with the proper functioning of website or App. You agree not to gain unauthorized access to any parts of the website or App, the server, or any computer or database connected to Aptamed website or App.

You agree not to impersonate or attempt to impersonate any of the service providers providing service, employee of Aptamed, another user or any other person or entity.You agree not to restrict anyone’s privilege of use of the website or App.

By accessing or registering on the website or app user understands and agrees that Aptamed cannot and do not guarantee that the website or App will be free of viruses or other destructive code. It is user’s responsibility to take appropriate measures such as anti-virus protection and accuracy of data input and output. It is user’s responsibility to maintain a means external to our website or App to preserve data in case the data is lost inadvertently from the website or the App. 

Registering on the website or App or accessing the website or App does not create any doctor-patient or other similar relationship between the user and the Aptamed. The Website or App is only meant as a resource to bring service providers and users together to facilitate co-ordination of care. All the communications and transactions between service providers and users shall remain between them and Aptamed is not involved in any manner whatsoever. Aptamed cannot and does not guarantee the accuracy of the information posted on the Website or App, including but not limited to the information regarding service providers. Aptamed does not guarantee or be in any manner responsible or liable for the provision of services by such service providers provided through the Website or App. Use of the website or app, its content and any services obtained or reserved through the website or app is at user’s  own risk. Services obtained or reserved through the website are provided on as available basis and without any warranties of any kind. Aptamed does not guarantee the completeness, security, reliability, quality, accuracy or availability of the website, app, or any of the services provided by the service providers through the website or app. Neither Aptamed nor anyone associated with Aptamed represents or warrants that the website or app, its content or any services obtained through the website will be precise, consistent, error-free or uninterrupted. Aptamed does not guarantee that defects will be corrected, that our site or the server that provides services are free of viruses or other harmful components. Aptamed does not guarantee that the website or app or any services obtained or reserved through the website or app will otherwise meet the users’ needs or expectations. Aptamed hereby disclaims all warranties of any kind, whether expressed or implicit, statutory, or otherwise. The above does not affect any warranties which cannot be excluded or limited under applicable law. By accessing or registering on the website or App you agree to defend, assure and hold innocuous Aptamed, its employees, and service providers from and against any claims, liabilities, damages, losses, expenses or fees arising out of or relating to your violation of these terms of use.

Content Ownership and Copyright Conditions of Access

The contents listed on the Website are user generated content, or belong to Aptamed. The information that is collected by Aptamed directly or indirectly from the end- users and the practitioners shall belong to Aptamed. Copying of the copyrighted content published by Aptamed on the website for any commercial purpose or for the purpose of earning profit will be a violation of copyright and Aptamed reserves its rights under applicable law accordingly.

Aptamed authorizes the user to view and access the content  on or from the website or app solely for ordering, receiving, delivering, and communicating only as per this agreement. The contents of the website, information, text, graphics, images, logos, software code, design, and the collection, arrangement and assembly of content on the website, are the property of Aptamed and are protected under, trademark, copyright and other laws. 

Limitation of Liability

In no event, including but not limited to negligence, shall Aptamed, or any of its directors, officers, employees, agents or content or service providers collectively, the “Protected Entities” be liable for any direct, indirect, incidental, consequential, exemplary or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the website or app or the content and functions related thereto, the Services, user’s provision of information via the website or app, lost business or lost end-users, even if such protected entity has been advised of the possibility of such damages. In no event shall the protected entities be liable for: provision of or failure to provide all or any service by Practitioners to end- users contacted or managed through the website or app; any content posted, transmitted or received b y or on behalf of any user or other person on or through the website or app; any unauthorized access to or alteration of your transmissions or data; or any other matter relating to the website or the Service. In no event shall the total aggregate liability of the protected entities to a user for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from this Agreement or a user’s use of the website or app or the services exceed, in the aggregate Rs. 1500/- (Rupees One thousand five hundred).

TERMINATION

Aptamed has the right to suspend or terminate a user’s access to the Website or app and the services with or without notice and to exercise any other solution available under law, in cases where, such user breaches any terms and conditions of the agreement as A third-party reports violation of any of its right because of your use of the Services. Aptamed unable to verify or authenticate any information provide to Aptamed by a user. Aptamed has reasonable grounds for suspecting any illegal, fraudulent, or abusive activity on part of such user; or Aptamed believes in its sole discretion that user’s actions may cause legal liability for such user, or for Aptamed or are contrary to the interests of the website or app. Once suspended, or terminated, the user may not continue to use the website under the same account, a different account or re-register under a new account. On termination of an account due to the reasons mentioned above, such user shall no longer have access to data, messages, files, and other content kept on the website or app by such user. The user shall ensure that they have continuous backup of any medical services the user has rendered to comply with the user’s record keeping process and practices.

USER CONTENT AND CONTRIBUTIONS

You understand and acknowledge that you are responsible for all the content you submit or contribute. You accept full responsibility for the content contributed including accuracy, appropriateness, and legitimacy. Aptamed will not be responsible for the accuracy of any user contributions posted on the website or App.

All the information except the personal identification and medical information contributed by the user to the website or App will be considered non-confidential and non-exclusive. By providing such information as a user the website or App, you grant us, respective licensees, service providers and each of their successors the right to use, reproduce, display, distribute and otherwise disclose to other users any such material per your account features set as per guidelines.

Aptamed website and App contains personal profile, personal records, messages, chat communications, updates, testimonials, or other interactive features that allow users to upload, post, display or transmit to other users or other persons content or other material the website or App. All these user contributions must comply with the content standards set out in terms of use and conditions.

You represent, acknowledge, and warrant that all of your user contributions do and will comply with these terms of use and that you own all rights to the user contributions. You acknowledge that you have the right to grant the license to Aptamed, service providers, and each of their licensees who provide the services through Aptamed website and App.

LEGAL COMPLIANCE and VIOLATION

By accessing or registering on website or app for services you agree Aptamed has the right to terminate or suspend any user access to all or part of the website or App for any or no reason, including without limitation to any violation of these terms of use. You agree that Aptamed has the right to take appropriate legal action, including without limitation, referral to cyber law enforcement, for any illegal or unauthorized use of the Aptamed website or App or the services provided through the website or App. Aptamed has no liability to anyone for fulfillment or non-fulfillment  of the services promised by service providers or users. 

You agree that Aptamed has the right to take any action with respect to your use of the website or App or content accessed or uploaded through you access that we deem necessary or appropriate in our sole discretion, including if we believe that such use violates the terms and conditions of use that threatens the safety of Aptamed, users, service providers or any person affiliated with Aptamed website or App.

Aptamed has the right to fully cooperate with law enforcement authorities or legal order requesting us to disclose the personal identification information of any user posting content on or through the website or App. By resorting to such action you waive Aptamed, its employees, and service providers using the website or App from any claims resulting from any action taken by the Aptamed during or as a result of its investigations and from any actions taken as a consequence of investigations by either the Aptamed or law enforcement authorities.

Aptamed has the right to disclose your identity or other information about you to any authorities who claim that content posted by you violates their rights, including their content or privacy.

Aptamed or service providers using website or App assume no liability for any action or inaction related to communications or content provided by any user or other service provider. Aptamed does not review any content posted by the user or service providers before it is posted on the website or App. Aptamed will try to remove any content that violates the terms of use but and cannot ensure prompt removal of content after it has been posted.

User content that is uploaded or downloaded to or from the website or App must comply with all applicable Indian and international laws and regulations. User content must not be abusive, offensive, obscene, indecent, defamatory, harassing, violent, hateful, or objectionable. User content must not infringe any copyright, patent, trademark, or other rights of any other user. User content must not violate the legal rights of other users. User content must not be sexually explicit or pornographic or violent. User content must not be discriminating based on age, sex, religion, race, nationality, disability, or sexual orientation.

User content must not cause inconvenience, annoyance or needless anxiety or be likely to upset, embarrass, frustrate, or annoy any other user. Content must not be used to impersonate any person. 

User content must not misrepresent your identity or affiliation with any person or organization and give the impression that it is produced by or advocated by Aptamed or service providers using the website or App if that is not the case.

Aptamed provides services only in India through website or App. We make no claims that the website or App or any of its content is accessible or appropriate outside of India. Access to the website or App may not be legal in certain countries. If you access the website or App from outside India, you do so at your own risk and you will be responsible for compliance with local laws.

Any dispute or claim arising therefrom or related shall be governed by and construed in accordance with the laws of India. Any matter relating to the website or App and terms of use shall be governed in accordance with the laws of India. Any legal suit, action arising related to, the terms of use or the website or App shall be instituted exclusively in the courts in Hyderabad, India. User waives all objections to the exercise of jurisdiction over the user by such courts. If any provision of these terms of use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the terms of use will continue in full force and effect.

APPLICABLE LAW AND DISPUTE SETTLEMENT

You agree that this Agreement and any contractual obligation between Aptamed and User will be governed by the laws of India.

Any dispute, claim or controversy arising out of or relating to this Agreement, including the determination of the scope or applicability of this Agreement to arbitrate, or your use of the Website or the Services or information to which it gives access, shall be determined by arbitration in India, before a sole arbitrator appointed by Aptamed. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Hyderabad. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.

Subject to the above Clause 9.2, the courts at Hyderabad shall have exclusive jurisdiction over any disputes arising out of or in relation to this Agreement, your use of the Website or the Services or the information to which it gives access.

PAYMENT FOR SERVICES

Terms of use apply to all purchases including appointments, subscriptions or any other payed services used through our website or App. These terms of use also apply to service providers who provide payed services Aptamed website or App. Additional terms and conditions may apply to services or subscriptions depending on the service provider providing payed services through website or App. User will abide by all such additional terms and conditions. Aptamed shall not be responsible or liable for enforcing of such terms and conditions for the service providers.

Cancellation and Refund Policy

In the event that, the medical practitioner or the service provider with whom user has booked a paid appointment via the website or app, has not been able to meet the user, user will need to write to us at aptamedcs@gmail.com within five 5 days from the occurrence of such event; in which case, the entire appointment fees as mentioned on the website or app will be refunded to the user within the next  7 business days to the user. In case where the user, does not show up for the appointment booked with a practitioner or the service provider, without cancelling the appointment beforehand, the amount will not be refunded. However, where cancellation charges have been imposed as charged by the service provider, user would not be entitled to complete refund even if user have cancelled beforehand.

Users will not be entitled for any refunds in cases where, the medical practitioner or the service provider is unable to meet the user at the exact time of the scheduled appointment time and the user is required to wait, irrespective of whether the user is required to wait or choose to not obtain the medical services from the said medical practitioner.

TELEMEDICINE 

Aptamed also offers online doctor consultations through website or App called Telemedicine visit. Telemedicine visit may be conducted through compatible video device. User will be able to communicate with the doctor whom the user has scheduled the appointment using the Aptamed website or App. While using the telemedicine visit, you agree to provide all relevant information pertaining to your medical history, treatments that other medical practitioners have recommended or currently followed by you. You also agree to provide all medical records available with you.

Per Telemedicine visit there will not be physical examination performed as this interaction is virtual and not in person. User agrees that the use of the online doctor consultation does not replace a physical examination conducted by a medical practitioner. Telemedicine visit should not be used for emergency medical services. By accessing the website, you agree that you understand that telemedicine visit cannot be used for emergency medical services.

Through Telemedicine visit Medical practitioner will not be able to perform physical examination and this might limit the critical information or other information that can be derived in an in person visit. You agree to obtain online doctor consultation despite the limitation mentioned above.

The treatment advice or prescription is provided by the medical practitioner on telemedicine visit is being provided per the information given by the user through the online consultation process and the advice or prescription may vary when examined in person due to the limitation of not examining in person. For this reason, the advice or prescription provided through online doctor consultation must not be interpreted as a final and conclusive medical opinion.

By accessing the website or App or by registering on the website or the App you agree that Aptamed or the Aptamed is not a medical service provider or a hospital and shall bear no responsibility or liability towards the medical advice or services provided by the service providers through Aptamed website or App this includes communications made with the service providers through telemedicine visit or communication made with the service provider in any other manner

Aptamed is not responsible for the medical advice or prescription provided to you through the telemedicine visit. Any such treatment or diagnostic advice shall remain strictly between the medical practitioner and user per Aptamed’s Privacy Policy.

During Telemedicine visit if the medical practitioner advices in-person consultation, then it is your responsibility to make a necessary appointment and obtain the in-person consultation. In case of any negligence on your part in obtaining an appointment in person and necessary medical advice in person, the Aptamed shall not be held liable.

The Privacy Policy, Terms of use and any other terms and conditions that user may be required to agree before or during the use of the website or App constitute the sole and entire agreement between the user and Aptamed with respect to the website and App and surpass all prior and concomitant agreements, representations and warranties, both written and oral, with respect to the website and App.
